1. Introduction
Welcome to OpenCommunityOutpost ("we," "us," or "our"). These Terms & Conditions ("Terms") set out the agreements for your usage of our yacht charter services and the website found at opencommunityoutpost.sbs (the "Service"), provided by OpenCommunityOutpost.
Engaging our services, such as booking a charter or using our Service, means you accept the Terms outlined here. Should you disagree with any section of these terms, you must not use the Service.
2. Service Overview
OpenCommunityOutpost offers a range of luxury yacht charter services which includes, but not limited to the following:
- Yacht hires for the day
- Evening boat tours
- Business getaway packages
- Exclusive private gatherings
- Extended charters
Our services are subject to both vessel availability and suitable weather. We hold the right to adapt or discontinue any service at our discretion anytime.
3. Booking and Reservations
3.1 Booking Process
For a reservation, you are required to:
- Attain a minimum age of 18 years
- Supply accurate and comprehensive details
- Settle the initial deposit as detailed in your reservation confirmation
- Adhere to these Terms & Conditions
3.2 Confirmation
A booking becomes valid only after we receive your payment and provide you with a written acknowledgement. We reserve the privilege to deny service to any person based on our judgement.
3.3 Availability
Our charters are contingent on the availability of the vessel and appropriate weather conditions. We endeavor to accommodate your requested schedule whenever possible.
4. Payment Terms
4.1 Pricing
Prices are expressed in € and include applicable taxes, except as specially noted. Prices may change without previous notification.
4.2 Payment Schedule
- Deposit: Half the total charter cost payable at the time of booking
- Remainder: Due two days prior to the charter's commencement
- Additional expenses (if any): Due when the charter concludes
4.3 Payment Methods
We accept several methods of payment, such as major credit cards, electronic bank transfers, and bank-certified drafts. Payment processing is completed using secure and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- 72 or more hours before departure: Full refund less transaction fees
- Between 24 to 72 hours prior to departure: 50% of the amount is refunded
- Less than 24 hours prior to departure: No refund is issued
5.2 Weather Cancellations
Should the weather be deemed unsafe by our captain, we will propose to either:
- Reschedule your trip to an upcoming date without any additional costs
- Issue a full refund if rearranging is not an option
5.3 Mechanical Issues
If mechanical difficulties arise with the vessel you've been allocated, our aim is to offer a comparable substitute. Should a suitable alternative not be available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are expected to:
- Adhere to all directions given by the crew
- Make use of safety equipment as necessary
- Alert us to any health conditions that could influence their safety
- Keep to the designated areas on the boat
6.2 Prohibited Items
Passengers may not bring aboard the following items:
- Glass containers
- Unlawful products
- Guns or any form of weaponry
- Excessive quantities of beverages (surpassing moderate personal use)
- Pets (with exceptions made if approved beforehand)
6.3 Conduct
We anticipate our passengers to behave respectfully. We reserve the choice to end any charter prematurely without refund if the conduct of any individual jeopardizes safety or impairs the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
We limit our responsibility to the cost you have paid for the charter. We are not liable for:
- Injury stemming from a passenger's own neglect
- The loss of or harm to personal belongings
- Indirect or exemplary damages
- Delays because of weather or events outside of our control
7.2 Insurance Coverage
Our vessels and operations are safeguarded through comprehensive marine insurance. You are accountable for acquiring your travel and personal property insurance.
7.3 Assumption of Risk
By taking part in our charters, you recognize that there are inherent risks involved in maritime activities and you take responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
We maintain the right to adjust itineraries, paths, or schedules in response to weather, safety, or operational needs. We will strive to provide a similar alternative experience wherever feasible.
9. Force Majeure
We shall not be considered responsible for delays, cancellations, or alterations stemming from circumstances outside of our control, including, though not limited to:
- Adverse weather
- Natural disasters
- Legal enforcement
- Port disruptions
- Technical malfunctions
10. Privacy and Data Protection
Your personal data is managed in conformity with our Privacy Policy. Using our services signifies your consent to the collection and usage of your information as delineated in said policy.
11. Intellectual Property
Copyright and trademark laws protect all material on our website, which includes text, imagery, logos, and graphics. Without our written consent, you must not duplicate, circulate, or generate derivative works.
12. Governing Law
These Terms are subject to the laws of France and any disputes will be settled in the courts situated in Nice, France.
13. Changes to Terms
We reserve the right to amend these Terms at any moment. Modifications will be noted with the revision date on our website. Continuation of service use after such changes signifies agreement to the updated Terms.
